Mmmhmmm. You probably should think a wee bit about the fact that bad guy, Kimberlin, actually had a restraining order when putting this story in perspective.

Walker, as an attorney or not, was subject to the specifications of that order. Montgomery County Maryland is not a place for a conservative thought. I submit that Walker might consider obtaining counsel.

Except of course Kimberlin committed perjury to get that restraining order, which is one of the things Walker tried to point out.

That Walker never actually violated that restraining, except in the mind of a self-confessed techno-ignorant Judge who seemed incapable of comprehending that blogging about biographical facts does not constitute issuing personal threats, would seem to be rather relevant as well.

And then of course there is the fact that Kimberlin himself did engage in acts that placed Walker in fear of his life, as well as engaging in harassment that resulted in Walker and his wife being fired.

So perspective is important for this story.

Now Walker did make an obvious mistake in continuing to represent himself in this case, particularly with a clearly biased Judge, but that does not change who the actual convicted terrorist is in this case, or which of them is more likely to be engaging in criminal actions at this time, even though officials in Maryland are unwilling to enforce the law against Kimberlin.

It is not my place to defend the bad guy in the matter. If the restraining order was issued in error it is between the court and the plaintiff. The respondent was aware of the order. Being a local to Montgomery County the respondent was also likely knowledgable about the character of the judiciary–if not, he is now.

No judge is ignorant in his own court–despite his lack of fitness for duty.

What happened outside of Maryland's jurisdiction is not relevant to the proceeding. Walker has different options and remedies but you don't arbitrate those matters in a far left liberal district court.

The judge had no burden to listen to a perjury defense from Walker, the restraining order was established, if Walker wanted to arbitrate the restraining order it would be another forum. Walker's defense is that he did not violate the conditions of the restraining order. Evidently, he did not sustain the argument with that judge.

Perspective is not an element of defense against a violation of an order. It sounds to me like Walker annoyed the judge–not a good idea.

If it is not your place to defend the bad guy in the matter then why are you doing it?

It is clear Walker made an error in his performance in court. If you read around the blogs even the people in it with him are saying that.
That does not change the facts of the case at hand, and that a convicted terrorist is getting away with lawfare.

I have not defended him. There are lessons to learned in this story, when you dance with the devil, you need to know the dance.

I have had some professional experience in the Montgomery County District Court and know what can happen. Walker will likely be vindicated. Lucky for Walker that it was not a landlord tenant contest.

This guy is such a mess, the Kimberlain troller.
I pulled up his wikipedia link and was amazed that any one person could be such a loser. http://en.wikipedia.org/wiki/Brett_Kimberlin

If breathing wasn't automatic, he'd be dead a long time ago.

            • NotKennedy says:

Ah, sure, seeing his picture I remember him now. Even Montgomery County will make short work of him. We have a similar character in this area who sues to stop anything in the way of development, land use, renovations, he hates anything that might make a new use for delapidated buildings. Some courts are starting to decline his petitions and charging him with abuse of the system by frivolous actions.

For a bum, with no potential for gainful employment, you have to wonder where he obtains wherewithall to file all of his legal shenanigans. Sounds like he needs to go out for a few beers with some of the local fellas in Dundalk!

      • LibertyWriter says:

Aye, and discuss the relative merits of the shillelagh o're a few pints o' plain and a give out.

I was thinking of the Dundalk near Baltimore, lol. It's one of those neighborhoods where folks don't wear hoodies if they are not from the 'hood! Good folks, if you live long enough to get to know 'em ;-)
